These Terms and Conditions govern access to and use of the application, website, and related services of Habla Pue, operated by DAISSACA E.I.R.L. By registering, accessing, or using the platform, you agree to be bound by these Terms.

1. Service

Habla Pue is a digital platform that may provide user interaction features such as messaging, profiles, filters, video-related features, virtual coin purchases, web chat access through QR login, and related tools.

2. Adults only

Habla Pue is strictly limited to users who are at least 18 years old. By using the platform, you represent and warrant that you meet this requirement.

If we detect reasonable indications that a user may be underage, we may request verification, restrict access, suspend the account, or permanently terminate it. Users remain responsible for the truthfulness of the information they provide.

3. Registration and account security

• You must provide accurate and sufficiently complete information to use the service.
• You are responsible for maintaining the confidentiality of your device, credentials, verification codes, and account access.
• Phone number verification may be required for registration, authentication, security, and account recovery.
• Phone numbers are not intended to be publicly exposed to other users as a normal feature of the service unless expressly indicated.
• You may not impersonate others, create accounts with false information, or use accounts without authorization.

4. Permitted and prohibited use

You agree to use the platform lawfully and in compliance with these Terms.

Prohibited conduct includes, without limitation:

• Using the platform while under 18 years old.
• Uploading, distributing, or promoting unlawful, fraudulent, abusive, deceptive, or rights-infringing content.
• Harassing, threatening, extorting, impersonating, or exploiting other users.
• Attempting to bypass platform protections, compromise security, abuse systems, or automate usage in an abusive way.
• Generating spam, mass abuse, fake engagement, or interfering with the normal operation of the service.

5. User content

You remain responsible for the content you create, upload, transmit, or otherwise make available through the platform, including text, messages, images, videos, names, and other materials.

You retain ownership of your content, but you grant Habla Pue a limited, non-exclusive license to host, store, process, transmit, display within the service, moderate, and technically distribute such content as necessary to operate, secure, and improve the platform.

This does not mean Habla Pue may freely use all user content for external advertising campaigns without limit. If content is used beyond normal platform operation or safety-related purposes, additional authorization may be required where applicable.

6. Privacy, contacts, and visibility tools

Habla Pue may offer privacy-related tools that use contact information, matching, or visibility controls to help users avoid unwanted exposure to personal contacts or mutual contacts. Such features are intended to improve user privacy and safety within the platform.

7. Private communications, moderation, and evidence

Chats and user communications are generally intended to remain private within the service. However, Habla Pue may apply proportionate automated safety and moderation controls, including temporary analysis or occasional safety-related captures where reasonably necessary to detect serious violations, protect users, prevent fraud, or comply with legal obligations.

If no issue is detected, such material may be discarded. If a violation or suspicious activity is detected, relevant material may be retained as evidence for as long as reasonably necessary for investigation, appeals, fraud prevention, legal compliance, or defense of rights.

8. Verification materials

Where age, identity, or safety verification is reasonably necessary, Habla Pue may request temporary supporting materials. As a general rule, such materials may be retained for up to 7 days and then deleted or anonymized, unless longer retention is reasonably necessary for fraud prevention, abuse review, appeals, legal compliance, or protection of the platform or its users.

As a general rule, Habla Pue does not intend to retain the full document number unless strictly required by law or a valid legal necessity.

9. Virtual coins, purchases, and non-refund policy

Habla Pue may offer virtual coins, credits, or similar in-platform values for use within the service. All such items are intended for internal platform use only.

• Purchases of coin packages or similar digital items are generally final.
• Except where required by applicable law, purchases are generally non-refundable once completed.
• Habla Pue is not obligated to convert virtual coins into money or to make monetary payouts to users unless expressly established under separate private rules or agreements.
• In exceptional and verified cases, Habla Pue may, at its sole discretion, offer internal platform credits or virtual coin adjustments instead of a monetary refund.
• We may review, limit, delay, suspend, or reject transactions where there are signs of fraud, abuse, error, chargeback risk, or policy violations.

10. Internal roles and operational rules

The platform may include different user roles and internal operational rules related to participation, interactions, allocations, or other service mechanics. Habla Pue may define, modify, interpret, or enforce such internal rules as necessary for the operation and integrity of the service.

11. Suspension or termination

We reserve the right to suspend, restrict, block, or terminate accounts temporarily or permanently in case of policy violations, fraud risk, security concerns, abuse, legal requirements, or harm to users or the platform.

12. Account deletion

You may request account deletion through: https://hablapue.com/delete-account/.

Deletion may involve deactivation, removal, or anonymization of certain data, while some records may be retained for a limited time where reasonably necessary for legal, safety, fraud prevention, evidence, or rights-protection purposes.

13. Intellectual property

The platform, software, branding, interfaces, and related elements are owned by Habla Pue or their respective rights holders and are protected by applicable law.

14. Service availability

We do not guarantee uninterrupted availability, error-free operation, or complete immunity from technical issues. We may perform maintenance, changes, updates, or service adjustments at any time.

15. Limitation of liability

To the fullest extent permitted by law, Habla Pue shall not be liable for indirect, incidental, special, or consequential damages arising from use of or inability to use the service, interactions between users, third-party failures, or events beyond our reasonable control.

16. Privacy Policy

Personal data processing is also governed by our Privacy Policy, which complements these Terms.

17. Changes to these Terms

We may modify these Terms at any time. The updated version will be published on this page with a revised effective date. Continued use of the platform means acceptance of the current version.
